POLICE COURT.
Wife Desertion.
Priscilla Edith Real proceeded against her husband, Arthur Real, a miner, for having left her and her two children without support.
Mr. E. R. Larcombe, instructed by Mr. D. P. Carey, appeared for the plaintiff and Mr. J. Pattison for the defendant, who pleaded not guilty.
Priscilla Edith Real, wife of the defendant, stated that she was married to the defendant on the 10th of August, 1904, in Rockhampton. She lived at Mount Usher, but later removed to Gavial. There were two children of the marriage-one twelve years of age, the other two years of age. The defendant was a miner. He was not at present living with witness. He had been away from her for nine years on September next. She was residing at Gavial when he left her. He did not tell her why he was leaving, but said that he was going to work at Mount Morgan and promised to send her some money. He had not given her or sent her any money ; but when she was in the Hospital in 1910, he gave her £5. She was still in bad health. The defendant had not given anything towards the support of his children. Witness had lived in the defendant's house at Mount Usher ; but the house was transferred to Gavial. The defendant gave witness the house. Witness's father and mother had been supporting her. It was nine years since she received the house and furniture from the defendant. The defendant was able to follow his occupation as a miner and was able to support her. Witness saw the defendant at Usher's Hotel and asked him what he intended to do. He said that he had offered witness a home. Witness replied that was nine years ago. She also said that she had one friend in Rockhampton who would advise her. When witness was in the hospital the defendant said that in three months' time he would provide a home for her at Mount Chalmers.
By Mr. Pattison : The defendant was working at the Victor mine at Mount Usher for some time. She had a brother who had some farming land at Midgee. The defendant rented twenty acres of that land. The defendant did not say that he would have the house removed to Rockhampton. Witness did not say to the defendant "I will not go away from my mother so long as she is alive." Witness had had to call the police in on several occasions on account of the defendant's conduct.
This was the case for the complainant.
Arthur Real, husband of the last witness, deposed that the complainant said that she would not leave her mother while she was alive and that she would come to witness after her mother died. In reply to this, witness said that he would go and look for work. He wrote several letters to the complainant, but did not receive replies to him. The complainant said that she did not want to go to Mount Morgan or Mount Chalmers. When he left the complainant she had £30 in bank and £20 in hand. When witness went to the Women's Hospital he gave the complainant £10. He had never ill-treated her.
By Mr. Larcombe : He did not send the complainant any money.
By Mr. Pattison : He would be prepared to provide a home for the complainant if she would live with him.
This was the case for the defendant.
Mr. Pattison asked that the case be dismissed.
The Police Magistrate : Do you think I am going to believe that offer of the defendant. Do you expert me to sympathise with this man on account of the way that he has treated his children ?
Mr. Pattison : I am not asking you to sympathise with my client. I am asking you to do justice.
The Police Magistrate : And that is all that you are going to get.
The Police Magistrate said that he would accept the evidence of the complainant and also that part where it came in conflict with that of the evidence of the defendant. He would find that there had been desertion and that the defendant had left his wife and children without means of support. He did not regard the defendant's offer of a home as bona fide. He would order the defendant to pay £1 per week for the support of his wife and 5s. per week in respect of each of his children, the first payment to be made forthwith, and the subsequent amounts to be paid every fortnight. He would also allow £2 2s. professional costs and 7s. costs of Court against the defendant.
