FRIDAY, 31st JULY.
(Before Messrs Fulton and Parkinson, J's.P.)
A FAMILY SQUABBLE.
Five cases of assault and damage to property were heard, all of which arose out of a trouble in the Powell family. Charles Powell sued his wife and daughter for assault, and the wife summoned the husband and sons for assault.
Mr T. W. Hancock appeared for the father and sons, and Mr Sewell (of Messrs Harwood and Pincotti for the mother and daughter.
Charles Powell, laborer, said Margaret Powell was his wife and Lily Powell his daughter. Last Sunday his wife was at Mrs Bell's. He had many reasons to complain against them. It was 25 minutes past 1 when they came home that night. His three sons and John Monkevitch were home with him. His wife was the worse of liquor, and his daughter looked as though she had been drinking. He had instructed his sons to put the girl outside if she was quarrelsome. She used some bad language, and Thomas Powell said, "You sit down, or I will throw you out." The girl was thrown out, and she said she would "do" for Thomas Powell. The mother and daughter then smashed the windows, and Margaret Powell hit him on the eye with, a spade, and said, "That got one home on you." About five minutes afterwards the two women went away, and subsequently came back, and commenced throwing at the house. It was 20 minutes to 4 before the trouble settled down. Margaret Powell said she would hang for him.
To Mr Sewell - About two years ago he was fined for assaulting his wife. He had ten children, and made his living by carting wood. His wife did not keep the house. She went out to do washing. His daughter had not earned 3s for herself during the last seven months. He did not strike his wife with a paling, and could not account for the marks on her arm. He did not strike the daughter whilst his sons held her.
To Mr Hancock - The damage to the window sashes was about £1. For a month he had to look after the children, as Margaret Powell had not done any housework.
Thomas Powell, laborer, said that he went to his father's house last Sunday. His mother and sister came home about half-past 1 in the morning. His mother was drunk, and his sister had been drinking. He was acting under his father's instructions in putting his sister outside the door. He ran away, and entered the house at the back. The woman and girl, with a spade and shovel, started to smash up windows. He never interfered with them. The mark on his father's eye was caused by his mother. His father never assaulted the women.
To Mr Sewell -- He did not strike his sister or his mother.
Attewell Walter Powell corroborated the evidence of the previous witness. His mother was the worse of liquor.
Charles Powell said his father had to stay at home and mind the children. His mother was drunk, and he could see that the girl had had some drink.
John Monkevitch stated that when Margaret Powell and her daughter came home they started to smash up things.
This closed the case for the complainant.
Margaret Powell, defendant, said she was not in the habit of drinking. She never had any drink at Mrs Bell's. She went out washing and doing other work. It was about five or six weeks ago since her husband worked. They went home early in the evening, before 10 o'clock. The place was locked. She put her hand in the window, and her husband struck her on the arm. The boys were all armed with sticks. On the Monday they went back to the house, and two of the boys punched Lily Powell. She did not smash the windows.
Lily Powell said that her father had given her a drink in the house, but she never had any outside. Her mother put her arms in the window, and her father and one of the brothers hit her mother with palings. The men had a crosscut saw inside the house.
To Mr Hancock - They were not on the premises at 1 o'clock in the morning. Her father had never objected to the time she came home.
Ellen M. Bell said she knew Mrs Powell and her daughter. There was no drink in the house on the Sunday in question.
Robert Gaul, of Elliminyt, said there was no drink at Mrs Bell's place. It was about 10 o'clock when the Powell's went home.
The Bench intimated that the whole of the cases would be dismissed, and advised the family to try and live in harmony with one another, other wise one party or the other would find that something serious would happen.

POWELL.--The Friends of the late Mrs. MARGARET ANN POWELL are respectfully informed that her remains will be interred in the Footscray Cemetery. The funeral will leave the residence of her daughter (Mrs. E. Russell), Pitt-street, West Footscray, THIS (Friday) MORNING, at 11 o'clock.

A young woman named Margaret Lennon, about seventeen years old, daughter of the well-known Patrick Lennon, was brought before the Court at Colac on Saturday last, on a charge of attempting to commit suicide, by jumping into the Barwon river. The girl was employed as servant at the Victoria Hotel, Birregurra, and has been suffering from severe hysterical seizures, after which she was generally very stupid. Some short time since she threatened to commit suicide, and on Friday she had a very severe fit. Shortly after recovering from the attack, the landlord of the hotel, Mr. Matthews, missed the girl, and Senior-constable Hadfield was sent for and informed of the circumstances of the case. Search was at once made, and the senior-constable discovered the girl standing on the banks of the Barwon. Upon seeing the police she jumped into the river, but the senior-constable at once went in after her, and brought her out. As the water was only about two feet in depth, the girl was not in any very great danger of being drowned. Dr. Rae considered that if the girl was removed from the hotel for a time, kept quiet and free from excitement, that her mind would recover its normal state. Mr. A. Dennis, who was on the Bench, committed the girl to take her trial at the General Sessions to be held at Geelong during the present month. There is not much justice or charity in a sentence of this kind, as the girl was undoubtedly in a half insane state from hysteria when she jumped into the river. [5]
