      Matrimonial Actions

      At the Supreme Court on Friday [29 Oct 1943] before His Honour Mr. Justice R. J. Douglas, the following matrimonial actions were heard:

      MACLENNAN v. MACLENNAN AND MATTHEWS
      Donald Even MacLennan of Tully, mill worker, sought a dissolution of his marriage with Frances Gertrude Emily MacLennan, on the grounds of adultery with William George Matthews.
      Mr. J. P. Quinn, instructed by Mr. I. H. Roberts (Roberts, Leu and North) appeared for the plaintiff. Irene Marjorie Crowder, law clerk, gave evidence as to service of the necessary documents.
      Donald Ewen Maclennan, plaintiff, stated that he was married on November 3, 1930, at Maryborough to Frances Gertrude Emily Spiller. After their marriage they lived in Maryborough for 4 years and then left for Tully, where they resided until February 3, 1937, when his wife left him. There were three children of the marriage. He was born in Scotland, but came to Australia in 1921. His wife was a very religious woman, but fell out with the church people at Tully. She got in with other people and went to dances at night. That was about 1936. The children were very young, and he remonstrated with her. In February, 1937, his wife packed up her clothes, and when he came home from the mill he found she had gone. He had to work on some nights, but his wife would not stay at home to mind the children. He got the police to find out where she was, and they told him she was in Townsville. He wrote her a letter and enclosed money to come home, but had never received any reply. In August, 1942, his wife came to Tully and stopped at a hotel for a fortnight. She had two children with her and she admitted to him they were the children of a Mr. Matthews.
      Neil Joseph Elms gave evidence as to visiting a house at Acaciavale and serving the writs. He also showed them two birth certificates and asked them if they were the persons mentioned as the parents, and they replied, "Yes."
      His Honour found the facts as alleged, and gave judgment, nisi for dissolution of the marriage, to be made absolute at the expiration of three months, with costs against the co-defendant.

      Sitting in chambers in matrimonial jurisdiction on Tuesday morning, Mr. Justice R. J. Douglas granted judgment absolute in the case in which Donald Ewen MacLennan, of Tully, was seeking the dissolution of his marriage with Frances Gertrude Emily MacLennan, on the grounds of adultery, William George Matthews being joined as co-defendant. The decree nisi was granted on October 29, 1943.
