      MAGISTERIAL INQUIRY.
      A magisterial inquiry in connection with the death of Charles August Smith was held at the Rosewood Police Court, yesterday, before Messrs. W. E. Collett and F. J. W. Eichstadt. Sergt Allen conducted the inquiry. George Jones, a farmer, said: I remembered Thursday, the 2nd in- stant. At about 10 a.m. I was on the corner of John and William Streets and saw a man, unknown to me, riding down the street at a gallop and flogging and spurring his horse. I was talking to another man at the time and I said, "lf a policeman saw him he would have him up." Opposite the Post-office, the horse kicked up and deceased fell off, head foremost, on to the street. I did not go to the man's assistance, but saw three or four others go. I consider no one was to blame for the accident, only himself. John Heiner, a dealer, said: I was engaged in my shop on Thursday 2nd January. I noticed Charles Smith galloping down John-street; the horse appeared to be bolting. I came to the door of my shop and watched him and noticed the horse give a few "pig jumps" opposite the Post-office, I noticed deceased's hat fall off and immediately afterwards deceased fell off. I ran to assist deceased and I and several others endeavoured to lift him to his feet, but he was unable to stand. I procured a trap and he was taken to the doctor's residence. I afterwards heard he was dead. I consider no one in the street was to blame as the deceased had lost control of the horse and the occurrence was accidental. Edward Millard, a farmer, said : I was in Mr. Sellar's shop on the 2nd instant. I heard a man riding fast down the main street. It attracted my attention. I went to the door of the shop to see who it was. I saw a horseman, but he was unknown to me. I watched the horseman as far as the post-office. The horse made a sudden prop, and gave a slight kick up. I noticed the rider go forward, and slip over the horse's head. I ran down to render assistance. I got up into a trap, and, with the assistance of others, deceased was placed in the vehicle, and taken to the doctor. I cannot blame anyone for the accident, and I consider the horse was beyond the rider's control. Sergt. Allen said : In consequence of a telephone message, I went to Dr. Wallace's surgery. On arrival I saw a man lying on a cushion, whom I identified as Charles August Smith, the deceased. He was being attended to by Dr. Wallace and Mr. Millard.   Dr. Wallace pronounced life to be extinct. I asked the doctor if he would furnish a certificate of death, but he stated he was unable to do so, as he had only seen the deceased a couple of minutes previously, and was unknown to him. Later in the day I attended a post-mortem examination that was made by Dr. Wallace, after which the doctor supplied a certificate of death, which shows that deceased died from a scalp wound, fatty degeneration of the heart, and shock. As no suspicious circumstances were disclosed, the inquiry was closed, and the depositions were forwarded to the Department of Justice.
