      ASSIZE INTELLIGENCE.
      GOULBURN CIRCUIT COURT.
      THURSDAY, SEPTEMBER 8.
      BEFORE Mr. Justice THERRY,

George Stephens, late of Cavan, in the colony of New South Wales, was indicted for the unlawful abduction, at Cavan aforesaid, on the 13th of July last, of one Susan Potter, a girl unmarried and under the age of sixteen years, from the care and custody of her mother.

Prisoner pleaded not guilty, and was defended by Mr. Purefoy; attorney, Mr. C. Walsh, Mr. George Allman, solicitor, appeared for the prosecution.

The CROWN PROSECUTOR shortly stated the facts of the case and called Emily Snoddon, sworn and examined : Lives at Carcoar ; was married before, my former husband was Captain Potter ; I have a daughter, Susan Potter, she is my second daughter; she was living with me at Carcoar in July last. Prisoner lived with me as a farm servant; I never gave him consent to take my daughter Susan away. I missed my daughter Susan at 11 o'clock at night on the 13th of July last ; went to bed about half-past nine ; my daughter was with me then ; she slept in the next room ; did not see the prisoner again until I saw him in the Court House at Yass ; my daughter Susan was there then. She will be 15 years old on 29th October next.

Henry Snoddon sworn and examined : Is husband of the last witness ; knows Susan Potter, my wife's daughter by her first husband. I know prisoner Stephens ; he was bullock driver to my wife ; he never asked my permission to take Susan Potts away, and I never gave permission.

Robert M Jennott sworn and examined : Is chief constable at Yass; apprehended the prisoner on 4th of August last at Shelly's Flats. He was under the verandah at the time. I told him he acted very foolishly in taking the girl away. Susan Potter was with me at the time, and made no remark whatever, I never spoke to her the whole time until we reached Yass.

This was the case for the Crown.

Mr. PUREFOY very briefly addressed the Jury, who, without leaving the box, found a verdict of Guilty. Sentence, 2 years in Goulburn Jail.
