A concert for the benefit of Mrs Delgaty and family will be given at Kaitangata this evening. The programme, which will be found in our advertising columns, possesses merits that should secure a full attendance. Mr Delgaty was well known to many in Balclutha and Kaitangata and throughout the Clutha district, and we are sure his old acquaintances will only be too glad to do what is in their power to make the concert successful in a pecuniary point of view. Regarding Balclutha we would point out that on many occasions the good people of Kaitangata have arranged for special trains to enable them to patronise similar entertainments in Balclutha. We have an opportunity of returning the compliment to-night. A special train will leave here at 6 30 p.m. returning at the close of the concert. There is thus no excuse left for non-attendance, and we hope to see both the train and the hall crowded.

The Concert in Gray's Hall, Kaitangata, on Friday evening, 1st inst., for the benefit of Mrs Delgaty, was a complete success in every respect. The purpose for which it was got up was praiseworthy in the extreme, and we were glad to see the public responded in a manner worthy of the occasion. Mr William Shore occupied the chair, and briefly, but feelingly, alluded to the object which had called them together that evening. He said he was glad to see such a large attendance for such a laudable purpose, but from the first time the question of the concert had been mooted, he had little doubt of the result, knowing the generous and sympathising hearts of the people of the district. He concluded by reading a letter of thanks from Mrs Delgaty, which he very truly observed spoke far more eloquently to them than any of the stereotyped phrases commonly used by Chairmen on similar occasions. He wished to thank them one and all for their attendance, and felt quite sure the pleasure the performers felt in giving their service was equalled by that of the audience in giving their assistance to such a benevolent object as the one that had called them together that evening. The programme was then gone through in first-class style, both vocal and instrumental. The usual votes of thanks to the performers, and the Chairman, brought the Concert to a close. A dance followed, which was patronised by old and young till an early hour the following morning, The proceeds amounted to L31.

A kitchen tea was given by Mrs. W. Hermann on Saturday evening at the residence of Mr. and Mrs. W. Goodman, Lowood, in honour of her niece, Miss Hilda Goodman, who will shortly be married to Mr. Walter Pointing (writes our Lowood correspondent). A large number of guests were present. Dancing, cards, and singing were enjoyed, and a happy time was spent. A large number of useful gifts were presented. During the evening Mr. J. W. Huston, on behalf of the guests, thanked Mrs. W. Hermann, and Mr. and Mrs. W. Goodman, for the splendid way in which they had been entertained, and for the happy time spent. He wished the intended bride and bridegroom every happiness and prosperity in their new life. Mr. W. Pointing responded, and thanked them all for their good wishes and useful presents.

A Lowood Auction Sale.
It is announced that the sale will take place at Lowood next Wednesday of the old established general store of Mr. H. Kitzelmann, together with the stock, &c. The offering will also include a cream depot and plant. The whole will be first offered as a going concern. The auctioneers are Messrs. Klatt, and Co., and Mr. Klatt advises that the sale will be conducted in both German and English. Further particulars are advertised.

A NONAGENARIAN PLAINTIFF.

Before Mr Justice Poole in the Civil court on Wednesday, John Bell Bennett, of Naracoorte, brought an action against his son, Patrick Bennett, to set aside the transfer of a farm. The plaintiff alleged fraud, misrepresentation, and undue influence against the defendant. The plaintiff stated that he was 93 years of age. Up to November 16, 1923, he was the registered proprietor of 1,153 acres of land near Naracoorte known as Bellvue, and owned 1,200 sheep and other live stock, and also plant, farming implements, and tools. On March 26, 1923, he alleged that he had been induced by fraud to sign an agreement of that date that he would not alter his will, and that on November 16 he had been further induced to sign an agreement and transfer whereby he assigned to the defendant all his farm, stock, plant, and implements, in consideration of the defendant agreeing to provide him with a home for the remainder of his life, and £200 a year. On November 10, 1924, the defendant ordered the plaintiff to leave the farm and refused to allow him to live there. The plaintiff claimed a rescission of the contract and a declaration that the agreements were void, and a return of the farm and the stock and implements, and an account of the proceeds of the farm since November. 1923. The defendant denied all the allegations of fraud, misrepresentation, and undue influence, and alleged that the agreement and transfer were signed after the plaintiff had had competent and independent advice, that he voluntarily left the farm, and that the defendant was willing to carry out the agreement. Mr W. A. Rollison, with Mr H. G. Alderman, appeared for the plaintiff. Mr G. C. Ligertwood represented the defendant.

A PIONEER SQUATTER. 

MANDURAMA, Wednesday.

Mr. William Montagu Rothery died at Cliefden, near Lyndhurst, early this morning. He was born in Devonshire, England, in 1809, came to Cliefden in January, 1831, where he has resided ever since. He married shortly after coming to Cliefden the daughter of Major Lockyer, for many years Sergeant-at-Arms in the Legislative Assembly of New South Wales. Mr Rothery was the oldest member of the Australian Club. He leaves five sons and two daughters. Mrs Rothery died ten years ago. Deceased was the first squatter in Australia who sent wool direct to England. He dealt with Messrs Balme and Co., London wool brokers, for 68 years.

On 24 June 1892 he was at Steenlille near Vexø with farmer Anders Rasmussen. Vexø is now know as Veksø and is about 30 km north west of Copenhagen city
